Sumgayit Court of Appeal

Sumgayit Court of Appeal hears, as a court of appeal, appeals and appeal protests made under court acts on the cases heard by the courts of first instance assigned to its territorial jurisdiction. Sumgayit Court of Appeal is comprised of a civil board, administrative-economical board, criminal board and military board.

Establishment of Sumgayit Court of Appeal

A three-instance court system – courts of first instance, courts of appeal and cassation was created in Azerbaijan as a result of one of the initial outcomes of the judicial legal reforms implemented with the leadership and close involvement of the national leader of Azerbaijan Heydar Aliyev, and this system moved into a new stage by the Decree dated 19 January 2006 issued by Ilham Aliyev, the President of the Republic of Azerbaijan, on modernization of the judiciary in the Republic of Azerbaijan and the implementation of the Law of the Republic of Azerbaijan “on Making amendments to certain legislative acts of the Republic of Azerbaijan”.Sumgayit Court of Appeal which began to function on 16 July 2007 is a court of high instance on civil, administrative cases and cases of economical disputes, criminal cases, as well as cases of administrative offenses.

Composition and powers of the Presidium of the court of appeal

Sumgayit Court of Appeal is comprised of a Presidium, civil board, administrative-economical board, criminal board and military board.Boards of Sumgayit Court of Appeal hear cases on the appeals and appeal protests made from the decisions taken by the courts of first instance assigned to their territorial jurisdiction as a court of appeal.Presidium of the court of appeal shall consist of the President of the court, his/her deputy and presidents of the chambers.Members of the Presidium of the court of appeal shall enjoy equal rights within their competence.
Presidium of the court of appeal shall be entitled to:

- form panels from the judges of the court of appeal;
- address motion regarding compliance of the legislation and other instruments with the Constitution and acts of the Republic of Azerbaijan to the Supreme Court to have it presented before the Constitutional Court of the Republic of Azerbaijan, in order provided by the legislation;
- hear information reported by the presidents of the Chambers of the court of appeal and presidents of the first instance courts within territorial jurisdiction of the relevant court of appeal on the subject of judicial practice of applying the legislation of the Republic of Azerbaijan;
- review summaries of judicial practice and analyses of judicial statistics on cases tried by the court of appeal;
- render systematical assistance to secure proper application of legislation by the first instance courts within territorial jurisdiction of the relevant court of appeal;
- exercise other powers vested in it by legislation of the Republic of Azerbaijan.
