Military Prosecutor's Office of the Republic of Azerbaijan besides being specialized prosecutor's office, carries out the powers delegated to the military procurator's offices in the Armed Forces, including in other armed formations envisaged by the legislation of the Azerbaijan Republic.Military Prosecutor's Office of the Republic of Azerbaijan controls observation of laws and military regulations at places of detainment and arrest of military personnel, disciplinary units, as well as the while application of penalties at military units.The military prosecutor's office executes their duties regardless of the military control bodies and commandment.In connection with the execution of official duties of the military prosecutor offices they can get a free access to buildings and offices of all military management bodies, military units, and military institutions.The military service of citizens serving in the military prosecutor's office, their reserve and retirement are done by the military prosecutor of the Republic of Azerbaijan.
While being in the structure of the former USSR the activities of prosecution bodies in the Republic of Azerbaijan were regulated by the Law of the Union "On the Prosecutor's Office", dated November 30, 1979. After the collapse of the Soviet Union those offices of prosecutor were abolished and the office of the military prosecutor of the independent Republic of Azerbaijan began to form.At present, the legal basis for the establishment and functioning of the military prosecutor office is the Constitution of the Republic of Azerbaijan of 1995,Law “On Prosecutor's” of the Republic of Azerbaijan dated December 7, 1999, the Law “On Prosecutor's Office bodies" of the Republic of Azerbaijan, dated June 29, 2001, as well as Laws of Republic of Azerbaijan “On Military Service", "On the status of military personnel" and other normative acts.
