National Television and Radio Council of the Republic of Azerbaijan was created by Decree # 795 of the President of the Republic of Azerbaijan dated 5 October 2002, aiming to provide implementation of state policy in the field of television and radio broadcasting and to regulate this activity.The main duties of the Council are to regulate the activities of television and radio broadcasters, to protect public interests in broadcasting, to carry out supervision on implementation of legislation on television and radio broadcasting.
Functioning of the Councilis regulated by “Statute about National Television and Radio Council”. The Council in its activity is guided by Constitution of the Republic of Azerbaijan, the Acts of the Republic of Azerbaijan, the Decrees and Orders of President of the Republic of Azerbaijan, the Decisions and Orders of the Cabinet of Ministers of the Republic of Azerbaijan and by “Statute about National Television and Radio Council”.
The Council is financed by state budget and is independent in its activity.The Council is being created by the President of the Republic of Azerbaijan and consists of 9 nine members. Three of them are being appointed for 2 years, three of them for 4 years and last three of them for 6 years. All of them have the right to be reappointed. They elect the Chairperson and the Deputy Chairperson among themselves. The leadership of the Council is carried out by Chairperson.
The Council prepares and implements unique development concept of television and radio field; determines the technical and quality standards of television and radio broadcasting; grants special permission (license) for television and radio broadcasting and for this purpose calls for competition; apply administrative penalties and other measures against broadcasters within orders and conditions determined in the legislation; according to the Law of the Republic of Azerbaijan “On Public television and radio broadcasting” organizes the work for putting forward of candidates for Broadcasting Council between relevant organization groups. The Council adopts decisions on its competence, which are compulsory for television and radio broadcasters.According to the Law of the Republic of Azerbaijan “On normative legislative acts” the decisions of NTRC are considered as secondary by-laws.
